1. Acceptance of Terms

By accessing or using LabRF's device-free radio training platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and LabRF. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance.

2. Description of Service

LabRF provides a software-based platform for simulated tactical radio and MANET network training. The Service includes:

  • Device-free radio simulation software
  • Access to vendor platform simulations based on subscription level
  • Training scenario creation and management tools
  • Support and updates as outlined in your subscription plan

3. Account Registration

Eligibility: You must be at least 18 years old to create an account.

Account Security: You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

Account Information: You agree to provide accurate, current, and complete information during registration and to update it as necessary.

Account Sharing: Each account is for individual use. Sharing login credentials is prohibited.

4. Subscriptions and Payment

Free Trial

  • Limited access to one vendor platform
  • No payment required
  • Can be upgraded to paid subscription at any time

Paid Subscriptions

  • Monthly: $40 per vendor platform per month
  • Annual: $408 per vendor platform per year ($34/month, billed annually)
  • Prices subject to change with 30 days notice
  • Billed automatically on renewal date

Payment Processing

Payments are processed securely through Stripe. By subscribing, you authorize LabRF to charge your payment method for the subscription fees. All fees are non-refundable except as required by law or specified in these Terms.

Failed Payments

If payment fails, we will attempt to charge your payment method up to three times. If payment remains unsuccessful, your subscription may be suspended or canceled.

5. Cancellation and Refunds

Cancellation: You may cancel your subscription at any time through your account portal or by contacting support@labrf.com. Cancellation takes effect at the end of your current billing period.

No Refunds: Subscription fees are non-refundable. You will retain access to the Service through the end of your paid period after cancellation.

Downgrading: You may downgrade from annual to monthly or reduce the number of vendor platforms. Changes take effect at the next billing cycle.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service or related systems
  • Use the Service for any illegal or malicious purposes
  • Reverse engineer, decompile, or attempt to extract source code
  • Share your account credentials with others
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Resell or redistribute the Service without authorization

7. Intellectual Property

LabRF Ownership: All content, features, and functionality of the Service, including software, text, graphics, logos, and trademarks, are owned by LabRF and are protected by copyright, trademark, and other intellectual property laws.

License: Subject to these Terms, LabRF grants you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business training purposes.

Your Content: You retain ownership of any training scenarios, configurations, or data you create using the Service. By using the Service, you grant LabRF a license to host, store, and process your content as necessary to provide the Service.

8. Disclaimers and Limitations of Liability

Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Availability

LabRF does not guarantee that the Service will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time.

Training Simulation Only

Important: LabRF is a training simulation platform. It does not provide actual radio communications capabilities. Users are responsible for verifying training outcomes meet their operational requirements.

Limitation of Liability

To the maximum extent permitted by law, LabRF shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Unauthorized access to your account or data
  • Errors, bugs, or interruptions in the Service
  • Any conduct or content of third parties

Our total liability shall not exceed the amount you paid to LabRF in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless LabRF, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Termination

By You: You may terminate your account at any time by canceling your subscription and contacting support@labrf.com.

By Us: We may suspend or terminate your access to the Service immediately, without notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Pose a security risk to the Service or other users

Effect of Termination: Upon termination, your right to use the Service ceases immediately. LabRF may delete your account and data in accordance with our data retention policies.

11. Export Controls

The Service may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export and re-export restrictions and not to export or re-export the Service to prohibited countries or individuals.

12. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Disputes: Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.

Exceptions: Either party may seek injunctive relief in court to protect intellectual property rights.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or notice in the Service at least 30 days before taking effect. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and LabRF regarding the Service.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment: You may not assign or transfer these Terms without our written consent. LabRF may assign these Terms without restriction.
